Sacramento Doing It Again
​

The State Legislature is again in session and again they are trying to over regulate businesses in California. The two following bills are pending in Sacramento and we hope you would please contact your elected Assembly or State Senator and let them know these are not necessary and would cost your business money:
                         
AB 161: Solid waste: paper waste: electronic proofs of purchase
 
This bill would make it mandatory to provide electronic receipts. You would have to give your information at the time of purchase and have your receipt emailed to you, no more paper receipts.
How much will it cost small businesses to retrofit or purchase new point of sale systems (POS)? Do you want every retailor to have your personal information? We have enough problems with security breaches on our credit cards, and now we would be giving out even more information to possibly be stolen. This also won’t reduce paper waste, especially if you get home and you want to have a hard copy of your receipt. You will print it out on a full sheet of paper. This legislation is unnecessary and if the author would like to cut down on wasted paper let’s quit proposing all these bills in California. California enacts two times more laws than any other state in the country.

AB 764: Sugar-sweetened beverages: nonsale distribution incentives
AB 766: Unsealed beverage container portion cap
These two bills would make it illegal for retailers to sell uncapped sugar beverages in an uncapped container of more than 16 ounces (AB766).and the second bill (AB764) would make it illegal for beverage companies to pay promotional money to retailers to promote the sale of products. Again the State is trying to mandate what we can do with our personal choices. By limiting the size of a beverage container doesn’t stop some from purchasing two beverages of 16 ounces and consuming both. Taking away the promotional dollars from retailers only hurts the retailors doesn’t hurt the beverage companies. The penalties associated with this are unbelievable, “if the person knew or reasonably should have known that the person’s actions violated this article, ($1,000) one thousand dollars per day for the first violation, ($2,000) two thousand dollars per day for the second violation, and ($5,000) five thousand dollars per day for the third and each subsequent violation”.
